Commercial Litigation

Commercial Litigation

We Provide Comprehensive Commercial Litigation Services

Farhang & Medcoff offers guidance for all types of commercial litigation. We represent both individuals and businesses involved in commercial litigation throughout the State of Arizona, from pre-litigation efforts at resolution through the appellate process.

How Is Commercial Litigation Different?

Commercial litigation generally proceeds in much the same way as other types of civil litigation. The parties hire attorneys, who then conduct investigations and attempt to resolve disputes without costly litigation. If pre-litigation efforts fail, the attorneys usher the case through discovery prior to the trial, which may lead to a trial or pre-trial settlement.

However, there are some key differences to be aware of with respect to commercial litigation.  Because commercial litigation involves at least one company, the cases tend to be more complex. Commercial litigation may also take the form of a class action lawsuit or a multi-district litigation (MDL).

Since commercial litigation may be more complex and challenging than other civil lawsuits, it’s imperative that clients hire a legal team with extensive experience managing commercial cases. At Farhang & Medcoff, our commercial litigation lawyers have spent years working collaboratively with our clients to develop strategic and sophisticated legal solutions designed to bring favorable results. We serve as your true ally, both in and out of the courtroom.

Common Types of Commercial Lawsuits We Handle

The commercial litigation team at our law firm has experience representing our clients across a range of types of cases, including the following:

Securities litigation
A securities lawsuit may occur when investors file a lawsuit against a publicly traded company, alleging violations of state or federal securities laws.

Breach of contract
Breach of contract allegations are among the most commonly litigated commercial disputes. Our attorneys can manage all types of contract cases, including claims of fraudulent inducements, anticipatory breaches, actual breaches, specific performance, and declaratory judgements.

Intellectual property
These cases involve allegations of an infringement of intellectual property, such as patents, copyrights, trademarks, and trade secrets.

Labor and employment disputes
Employees or job candidates may sue companies for alleged violations of employee protections, such as wage and hour laws, anti-discrimination laws, anti-retaliation protections, and whistleblower allegations.

Product liability
Consumers may file lawsuits against manufacturers over allegations of defective products and breach of implied or express warranties.

Our commercial litigation team represents our clients in state and federal courts, as well as in administrative hearings and appeals. We also offer alternative dispute resolution services.
